Conservative litigation against sexual and reproductive health policies in Argentina

For the last ten years, Argentina has seen an increase in litigation related to sexual and repro- ductive rights. The dynamics between the actors and the ways in which these cases have made it into the courts have played out in different ways. On the one hand, LGBTIs* have turned to the courts in an attempt to widen the spectrum of sexual rights. It was in this way, for instance, that prior to the Civil Code reform legalizing same-sex marriage in 2010, the Argentinian Fed- eration of Lesbians, Gays, Bisexuals and Trans (FALGT),† founded in 2006, launched a successful legal strategy to seek authorization of a series of same-sex marriages through the courts of justice. Their purpose was to open a national debate and set legal precedents that would lead to a transfor- mation in the country’s legislation on marriage.
